1. General

StartAScrapbook.com welcomes you to the StartAScrapbook.com Community hosted by StartAScrapbook.com. The StartAScrapbook.com Community consists of the message board (also called a forum), Online Chat, Private Messaging, Classified Ads with commenting and Photo Gallery with commenting.  The purpose of the StartAScrapbook.com community is to provide a family friendly community style environment on the internet where Scrapbookers and those interested in Scrapbooking can discuss this craft and associated crafts along with other general discussion topics.  We take pride in the way that the community is administered and having the ability to show banner advertisements to guests only; blocking them from the view of registered members that are logged in.

2. User’s Acceptance of Terms of Use

These Terms of Use shall govern your access, visits and participation in the StartAScrapbook.com Community.  By registering for a StartAScrapbook.com Community account, by using or visiting the community, you are subject to the Terms of Use.  If you do not agree to all of the Terms of Use, you should not access, visit, or participate in the StartAScrapbook.com Community in any way.  StartAScrapbook.com reserves the right to modify, suspend or terminate the StartAScrapbook.com Community and/or these Terms of Use from time to time at its sole discretion and without notice.  The StartAScrapbook.com Community is provided on an AS IS and AS AVAILABLE basis.  StartAScrapbook.com will not be liable to you or any third-party for any claims or actions arising or resulting from your use, visit, or participation in the StartAScrapbook.com Community and for any modification, suspension, or termination of the StartAScrapbook.com Community, or termination of your access to the StartAScrapbook.com Community.

3. Registration

You must be at least eighteen (18) years old to use and participate in the StartAScrapbook.com Community. If you wish to have a StartAScrapbook.com Community account, you must provide current, accurate, and complete information about yourself during the account registration process.  By joining the StartAScrapbook.com Community, you expressly agree to be bound by the Terms of Use as entered into by and between StartAScrapbook.com and you. You are responsible for maintaining the confidentiality of your StartAScrapbook.com Community password and account, and assume all liabilities and responsibilities for any and all activities that occur under your account. You must maintain and promptly update any account information provided to the StartAScrapbook.com Community in order to keep such information up to date, accurate and complete. StartAScrapbook.com reserves the right to refuse access to the StartAScrapbook.com Community to anyone, at any time, without notice, and for any reason.

4. Conduct

You must abide by the following rules of conduct:

a. Do not engage in any unlawful conduct in the StartAScrapbook.com Community. In particular, do not post, publish, or distribute any defamatory, obscene, infringing or other unlawful material or information in the StartAScrapbook.com Community.

b. Treat others in the StartAScrapbook.com Community as you would expect them to treat you. Do not engage in personal attacks or any type of "flaming" of other users. Do not "troll", i.e. post topics or opinions that are designed to provoke a negative response from one or more specific users.

c. Do not use offensive language. If you have any doubts about whether a particular statement might be considered offensive by other users, do not post it.

d. Do not engage in disruptive activity in the StartAScrapbook.com Community, such as persistent off-topic contributions or comments, or statements that might incite other users to violate these guidelines or participate in illegal activities.

e. Do not contribute content that contains photos, software or other material protected by intellectual property laws, rights of privacy or publicity, or any other applicable law unless you own or have rights to these materials.

f. Do not post any instructions, software or other materials that would allow participants or third parties to harm other users' computers or to inappropriately access software or websites.

g. Do not post any computer programs that contain destructive features, such as viruses, worms or Trojan horses. Do not employ any type of bots for the use of scrolling, showing multiple screens, or other activities that might disrupt online communication.

h. Do not falsely impersonate any other person in the forum, including StartAScrapbook.com Community Administrators or Moderators.

i. Do not use the StartAScrapbook.com Community to spam other users, including sending identical and irrelevant submissions to many different discussion areas, Private Messages, Chats, the Email This Member Feature or any other area of the StartAScrapbook.com Community.  Do not post items for sale in the classified advertisments from your store or company, the classified ad section is for personal sales only.

j. Do not misrepresent the source of anything you contribute.

k. While you may use the StartAScrapbook.com Community to provide information about a business that might be of interest to other users (without spamming them), the StartAScrapbook.com Community is not to be used as a platform for you to contribute content which may be considered an advertisement for a product, service or business, or posting of items for sale in the classified advertisement section from your company, business or storefront.  StartAScrapbook.com is not responsible for any products, services or businesses which may be found posted in the community and the purchase or use of any product, service or business that is posted within the StartAScrapbook.com Community is solely at your own risk, and StartAScrapbook.com assumes no liability for such purchase or use.

l. Any space provided to you in the StartAScrapbook.com Community is for your own personal use (Not advertising products or services), and may not be sold, licensed, exchanged or bartered for any purpose.  This includes storage space on the StartAScrapbook.com server, and all areas within the StartAScrapbook.com Community to include Signature Lines.  StartAScrapbook.com reserves the right to edit or delete any information which we may consider to be an advertisement at any time at its sole discretion and without notice.  We also reserve the right to modify member permissions to disallow any feature which we consider being used as a means of advertising at any time without notice.   Advertising space is available through StartAScrapbook.com and will allow you to promote your product, service or business in a way that will not be in violation of our Terms of Use.  For more information, please contact webmaster@startascrapbook.com

m. You are responsible and liable for all your activities while participating in the StartAScrapbook.com Community, including anything you contribute.

n. Do not rely on the StartAScrapbook.com Community for the safe and secure storage of any materials, such as photos, documents and software. The StartAScrapbook.com Community is not designed as the primary place to store any of these materials, and StartAScrapbook.com is not responsible for the alteration, deletion or loss of any stored items. Create back-ups for any materials that you contribute to the StartAScrapbook.com Community.

o. StartAScrapbook.com reserves the right to remove at any time, without notice, any contribution that violates these guidelines. StartAScrapbook.com also reserves the right at any time, without notice, to warn, ban and or delete a user who has violated these rules of conduct from any or all areas of the StartAScrapbook.com Community.

p. Some participants may post Internet website links in the StartAScrapbook.com Community. StartAScrapbook.com is not responsible for the content on the websites associated with these links. In addition, we must remind you that some content and links on the Internet contain adult content that is not suitable for children and may be offensive to some users.

q. You are responsible for any actions you may take based on information or advice you receive while online. Use your own good judgment when evaluating information provided through the StartAScrapbook.com Community or any other communication service. The decision to share information or conduct transactions with anyone is your own; therefore conduct your own research prior to making any decisions.

5. Contributions

There are opportunities for you as a user of the StartAScrapbook.com Community to actively participate by creating, providing, sharing and uploading information to the StartAScrapbook.com Community such as comments, ideas or suggestions and other information  (collectively “Contributions”). Contributions in the StartAScrapbook.com Community are subject to the Terms of Use. StartAScrapbook.com assumes no responsibility or liability over the sharing of Contributions among users.

Any Contributions provided by you to the StartAScrapbook.com Community may be editable and freely used by the StartAScrapbook.com Community and other users within the StartAScrapbook.com Community. Ways in which your Contributions may be used include, but are not limited to, creating comments, articles, documents, FAQs, or knowledge bases. For example, users may incorporate discussion threads written by other users into new documents. Additionally, users may incorporate documents written by others to create a new list of FAQs. StartAScrapbook.com shall have the right to retain and use Contributions, in edited or unedited form, for any purpose in any way including but not limited to re-posting such Contributions to other areas of the StartAScrapbook.com Community and website, by using Contributions in current or future products or services, or even give or sell your Contributions to others. Therefore, do not upload Contributions to the Communities unless you agree to these Terms of Use. StartAScrapbook.com Community is under no obligation to post or use any Contributions provided by users and StartAScrapbook.com may in fact remove any Contributions at any time at its sole discretion for any reasons.

6. Contributions Ownership, Rights and Liability

StartAScrapbook.com does not claim ownership of any Contributions that you or other users post, upload, submit or otherwise provide to the StartAScrapbook.com Community. By providing Contributions to the StartAScrapbook.com Community, you grant to StartAScrapbook.com a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute such Contributions and derivative works. Additionally, by providing Contributions to the StartAScrapbook.com Community, you grant to StartAScrapbook.com a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable patent license to make, have made, use, offer to sell, export, and otherwise transfer or sublicense such Contributions. You also grant StartAScrapbook.com and all users of the StartAScrapbook.com Community the permission to use your Contributions in other areas of the StartAScrapbook.com Community.

In order to grant StartAScrapbook.com Community and other users of the StartAScrapbook.com Community the rights, permissions and licenses contained herein, you represent and warrant that you either own or have all the necessary intellectual property rights in the Contributions uploaded or shared to the StartAScrapbook.com Community and that your Contributions are non-infringing on the patent, copyright or other intellectual property rights of others. Do not post, upload, submit or otherwise provide Contributions to the StartAScrapbook.com Community that are protected by the intellectual property rights of others, unless you own or have the necessary rights or licenses to use such Contributions.

All Contributions are deemed be provided on a non-confidential basis. StartAScrapbook.com is under no obligation to and does not control the Contributions created, provided or uploaded to the StartAScrapbook.com Community. The nature of some Contributions may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. StartAScrapbook.com Community reserves the right to take down and remove Contributions that are flagged by users or deemed by StartAScrapbook.com as objectionable. However StartAScrapbook.com is under no duty to take down or remove any Contributions.

8. Indemnification

If StartAScrapbook.com and its subsidiaries, affiliates, directors, officers, agents, and employees should incur any liability to a third party arising out of or in any way related to your use of the StartAScrapbook.com Community, you agree to indemnify and hold StartAScrapbook.com free and harmless from any such liability, and from all loss, claims, costs, demands, debts and causes of action in connection therewith, including reasonable attorney’s fees.

9. Privacy Policy

StartAScrapbook.com does not require that you provide personal information, the decision to provide personal information is voluntary. However, in order to register for an account with the StartAScrapbook.com Community, you must provide your email address. By providing your personal information to StartAScrapbook.com, you consent to the collection, processing and storage by StartAScrapbook.com of your personal information in accordance with the following terms of StartAScrapbook.com’s Privacy Policy.

StartAScrapbook.com respects the privacy of our visitors (guests and registered members).  StartAScrapbook.com does not collect real names, addresses, phone numbers, financial information or any sensitive personal information.  Any information about a registered member collected is used for internal use only such as contacting an individual should the need arise, maintaining a list of registered members, and any other internal use which we deem necessary to maintain the community. We will not sell or share your registration information with any other party.  all information is stored in a database with security measures in place to protect that data.  We attempt to make backups of the data several times a day and those backups are saved in a password protected location not residing on the internet.

StartAScrapbook.com does not require you to share personal information such as phone numbers, real names and addresses.  Any sharing of such information within any area of the StartAScrapbook.com Community is done so at your own risk.  Although you must be a member to use many areas and features of the StartAScrapbook.com Community, you should not post any personal information in any area of the StartAScrapbook.com Community.  StartAScrapbook.com does not guarantee the security of any information posted anywhere in the StartAScrapbook.com Community. You can view the information that we have on file for you by visiting your control panel and choosing the different areas.  You can also edit any information from those areas at any time or contact the administrators of the StartAScrapbook.com Community to change the information for you.
